  1. Telcel o cualquiera de sus afiliadas o subsidiarias (colectivamente, "Telcel") provee este servicio de reciclaje para iPhone, sin costo para sus clientes. El servicio de reciclaje contempla el reuso del iPhone y/o sus partes. En la medida que lo permita la ley correspondiente, por el presente Telcel, no provee y excluye todo tipo de garantías, ya sean expresas o implícitas.
  2. El cliente manifiesta y garantiza que cuenta con el carácter y titulo legal suficiente para permitir a Telcel prestar el servicio. ”Cliente” significa en abajo firmante que es el propietario del iPhone o ha sido autorizado por el propietario del iPhone para decidir sobre el iPhone.
  3. Una vez el Cliente entregue su iPhone para reciclaje, el cliente transferirá el titulo del iPhone al Reciclante a través de Telcel y renuncia a cualquier derecho, titulo o interés sobre el iPhone y/o cualquier concepto contenido en el mismo. El Reciclante será la parte ajena a Telcel, que proveerá los servicios de reciclaje.
  4. El cliente entiende, reconoce y acuerda que Telcel actua únicamente como un intermediario del Reciclante y que exclusivamente estará recolectando los iPhone en favor del Reciclante. Telcel y el Reciclante no pueden y no garantizan que procederán con cualquier solicitud de devolucion de un iPhone.
  5. El cliente reconoce que no es un revendedor de Telcel, que el iPhone no es falsificado, robado o fraudulento, que no hay prendas, gravámenes o garantías sobre o en relación con el iPhone; el intercambio y venta y envio de iPhones no viola ni violara cualesquiera leyes y que según tiene conocimiento el cliente, no viola derechos de propiedad intelectual de cualquier tercero.
  6. El Cliente acepta que es el único responsable de resguardar, grabar y copiar cualquier informacion contenida dentro del iPhone antes de transferir la propiedad del iPhone al Reciclante y que el Cliente ha tomado las precauciones pertinentes para eliminar informacion y archivos de caracter personal y confidencial. La recuperacion de informacion y datos, no es parte del servicio de reciclaje, por lo cual Telcel y el Reciclante no tienen ningún tipo de responsabilidad por datos o archivos extraviados una vez que reciban el equipo.
  7. Cualquier concepto proporcionado al Reciclante a través de Telcel como parte del servicio de reciclaje, no debra ser violatorio de ninguna ley aplicable, incluyendo leyes de exportación y el cliente Cliente acepta y ratifica que ha cumplido y complira con todas esas leyes.
  8. El Cliente manifiesta y garantiza que cualquier concepto objeto de reciclaje mediante el programa no: (1) Viola cualquier derecho de propuedad intelectual de cualquier tercero, (incluyendo sin limitacion derechos de autor, marcas registradas, patentes, secretos comerciales u otros derechos propietarios) (2) falsificados, robado o fraudulento
  9. Este servicio es proporcionado unicamente con propositos legales y el cliente acuerda indemnizar a Telcel y al Reciclante y a cualquiera de sus directores, ejecutivos, empleados, afiliadas, subsidiarias o agentes de y contra cualquier reclamo entablado en contra de cualquiera de los mismos, relacionado con la prestacion de este servicio en nombre del cliente o por incumplimiento a los términos y condiciones de este programa por parte del Cliente.

Hasta donde lo permita la ley aplicable, la responsabilidad total del Reciclante, Telcel y sus afiliadas en relación con este servicio no excederá un maximo de $ 50 USD
  11. Esta oferta es invalida cuando sea prohibida o restringida por la ley
